Establishment of Index Pricing

Cardsphere monitors real time price data from multiple sources and uses this data, combined with internal transaction and pricing activity to establish a reference Index Price for items in near-mint condition. Items in other conditions are priced lower based on the information provided in the Cardsphere Condition Guide.

Index Price is often volatile and changes fast. Cardsphere cannot be held liable for any sending, receiving or trading performed by you on the basis of the Index Price provided by Cardsphere.

To protect you from Index Price volatility, Cardsphere offers Price Limit feature free of charge.

Trading

Any two registered users in good standing can engage in trading activity with the help of Cardsphere marketplace.

Cardsphere allows users to trade collectible cards, also known as Items. Each item has several properties that jointly describe the Item:

  1. Name
  2. Printing or Edition
  3. Finish
  4. Language
  5. Condition

A Trade is a marketplace transaction that involves one tradable Item and two users: a Sender and a Receiver: the Sender is in possession of the Item; the Receiver has previously requested to receive such an Item. An Item is the material good with or without attached non-material value, such as promotional codes or contest entries. Non-material value may not be traded separately from the material good.

As a Cardsphere user you can assume the role of a Sender, Receiver or both.

A trade can be initiated by Senders and by Receivers:

  1. by Sender by committing to send an Item to a Receiver
  2. by Receiver by requesting an item from a Sender

A trade concludes when either of the following happens:

  1. The Item is received by the Receiver and is verified to be as described.
  2. The transaction is concluded with the help of Dispute Resolution service.

As part of a Trade, an amount of Stored Value can be transferred from Receiver to Sender via Trustee Service, as a payment for the Item.

Overview of Sending Process

As a Sender you are expected to follow the procedure described below to send Items:

  1. Using provided Collection Management Tools, you can list any number of tradable Items that you intend to make available for sending. The list of such items is called the Haves List.
  2. Using provided Matchmaking Service, you can periodically check for availability of potential Trades.
  3. You can decide to act upon any potential Trade and commit to send the Item to the Receiver indicated in the potential Trade.
  4. After you have initiated a Trade, you must promptly ship the Item to the Receiver.
  5. You should contact the Receiver via Messaging Service or open a Dispute in case when the Receiver does not mark an Item as received in a reasonable amount of time.
  6. Using provided Matchmaking Service, you can can engage in passive sale of Items and expect Receivers to commit to receive Items from you.

Your Obligations as Sender

You must maintain an accurate Haves List. Failure to do so may lead to breaking a number of other obligations.

You must evaluate the condition of the Items on your Haves List according to the Condition Guide. Failure to do so may result in disputed Trades.

You must ship Items within 3 business days following the moment you initiated a Trade. Failure to do so may result in disputed Trades.

It is your sole responsibility to make sure the Item is delivered to the Receiver in a reasonable amount of time in the described condition.

You must include enough information with each shipment for the Receiver to recognize and attribute the Item(s) received to the respective Trades. Failure to do so may result in disputed Trades.

You bear all costs associated with the shipment of the Item to the Receiver, excluding import taxes and duties. You cannot use any shipping method that would require the Receiver to pay shipping costs (cash on delivery). If insufficient postage charges are required for the Receiver to take possession of the package, such costs will be recovered on behalf of the Receiver from Sender's stored value.

When shipping internationally, you must conf irm that your shipping method is acceptable with the receiver where a method other than and ordinary, plain white envelope (PWE) is being used. Receivers may choose not to accept packages shipped via unapproved methods.

You bear all risks associated with the shipment of the Item to the Receiver, such as loss or damage in transit. It is up to you to arrange 3rd party insurance for the shipment at your cost. In the event that the item arrives not as promised, the receiver may choose to ship it back at the Sender's expense and risk.

When trading Items with attached promotional codes you must ensure that such codes are authentic, redeemable, not expired, not due to expire before delivery. You must ship the material Item with the codes.

In addition, Cardsphere reserves the right to temporary or permanently suspend service and/or withhold accumulated Stored Value for any user engaged in the following practices:

  1. Senders knowingly or unknowingly shipping counterfeit Items to Receivers. Counterfeit Items will be seized and destroyed.
  2. Senders knowingly shipping sealed Items that have been tampered with to Receivers.
  3. Senders knowingly shipping sealed Items whose contents have been previously determined ("mapped") to Receivers.
  4. Senders engaging in Trades due to changes in Item value not reflected on Cardsphere.
  5. Senders with excessive number of disputes open against them.
  6. Senders engaged in any fraudulent activity.
  7. Senders canceling Trades due to changes in Item value after it is committed but before it is shipped.
  8. Senders delivering codes that are non-authentic, non-redeemable, expired, or about-to-expire.
  9. Senders delivering codes using any other method except delivering the Items that the codes are attached to.
  10. Senders canceling Trades due to a better offer becoming available.
  11. Any users colluding with other users for the purpose of using Cardsphere service to transfer funds without transacting a physical item (ghost trades, fake trades).

Overview of Receiving Process

As a Receiver you are expected to follow the procedure described below to receive Items:

  1. Using provided Collection Management Tools, you can enlist any number of tradable Items that you want to receive. The list of such Items is called the Wants List.
  2. You can use Collection Management Tools to set offers expressed as percentage of Index Price for Items on your Wants List.
  3. You are encouraged to use Collection Management Tools to set price limits for Items on your Wants List.
  4. Using provided Matchmaking Service, you can can commit to receive Items from Senders.
  5. You must examine incoming shipments and attribute the Item(s) to respective Trades.
  6. You must promptly mark any received Items in as described condition as accepted with Cardsphere.
  7. You should contact the Sender via Messaging Service or open a Dispute in case any Item is not received in a reasonable amount of time or is received but is not as described.

Your Obligations as Receiver

You must maintain an accurate Wants List. Failure to do so may result in receipt of unwanted Items or Items at prices higher than expected. Where this is the case, it is not a valid reason for a Transaction dispute, no remedy can be provided by Cardsphere

You must maintain a current and accurate mailing address with Cardsphere. Failure to do so may result in disputes open due to lost mail be ruled against you.

You must ensure that the mailing address you use to receive Items is suitable for such activity. That includes, but not limited to:

  1. You must have the ability to check for delivered Items at least once every 3 business days.
  2. Items must not be exposed to elements.
  3. Items must not be exposed to possibility of theft or vandalism.

Failure to do so may result in disputes open due to lost mail be ruled against you.

You must cooperate with the delivery service (e.g. postal service, UPS, FedEX, DHL, courier etc.) to take possession of the Items being delivered. Failure to do so may result in disputes open due to lost mail be ruled against you. This does not extend to paying for insufficient postage charges. Receivers may refuse the shipment under these circumstances without being held responsible by Cardsphere. If insufficient postage charges have been paid by the Receiver to take possession of the package, such costs will be recovered on behalf of the Receiver from Sender's stored value. Proof of payment must be presented to Cardsphere admins.

You must attribute received Item(s) to corresponding Trades and either:

  1. Promptly mark any received Items in as described condition as accepted with Cardsphere.
  2. Promptly open a dispute for each item not as described with Cardsphere. Failure to dispute cards leaves no further recourse available. Receiving cards without a dispute means agreeing items were delivered as promised.

You must be able to comply with all instructions from administrators with respect to testing card authenticity in a timely manner. High quality images are required when card authenticity is challenged.

A Receiver cannot dispute the condition of items for which the Sender has shared images prior to shipping and for which the Receiver and the Sender have agreed on a specific condition, providing the images accurately demonstrate the actual condition as ruled by Cardsphere staff.

In cases when any Disputes related to received Item(s) not as described is ruled in your favor as a Receiver, you must cooperate with the Sender to ship such Items back to Sender as Sender's expense if the Sender so wishes.

You are responsible for paying any import taxes or duties associated with the receipt of Items. Refusing delivery of Items where import duties or taxes apply where the value has been accurately represented transfers the risk of loss during the return onto you.

Other Unacceptable Behavior

  1. You are not allowed to create more than one user account with Cardsphere without prior written permission from Cardsphere.
  2. You are not allowed to use any Cardsphere account that is not your account.
  3. You are not allowed to knowingly provide false information to Cardsphere administrators or other Cardsphere users.
  4. You are not allowed to disseminate personal information of other Cardsphere users except for the purpose of fulfilling your obligations as Sender.

Trustee Service

When a Trade is initiated by a Sender, Cardsphere takes an amount of Stored Value equal to the value of the Item being traded from Receiver's Stored Value balance and holds it in trust. This way Cardsphere guarantees that the Sender can be paid by the Receiver when the Trade is concluded.

When a Trade is concluded in such a way that the Sender is entitled to receive all or a portion of the Stored Value held in trust for this Trade, Cardsphere will withhold Trustee Service Fee in the amount of the greater of the following:

  1. 3% of the Stored Value to be transferred from trust to the Sender's Stored Value Balance (rounded up)
  2. 1 cent

As a Sender you can open a dispute in conjunction to a particular trade in the following cases:

  1. The Receiver has not indicated the receipt of the Item in a reasonable amount of time; in addition the Receiver cannot be reached for comment.

  1. Full Refund. Cardsphere will transfer the full amount of Stored Value held in trust for this trade to the Receiver. In addition to that, in case the Receiver chooses to return of one or more items to the Sender in accordance with the provisions of this agreement, Cardsphere will transfer an amount of Stored Value from the Sender to the Receiver for the purpose of reimbursing the Receiver for the costs associated with shipping the items back to Sender using the method specified by the Sender.
  2. Split. Cardsphere will transfer a portion of the amount of Stored Value held in trust for this trade to the Receiver. Cardsphere will transfer the remaining portion of the amount of Stored Value held in trust for this trade to the Sender, minus applicable Trustee Service Fee.
  3. Full Payment. Cardsphere will transfer the full amount of Stored Value held in trust for this trade to the Sender, minus applicable Trustee Service Fee.

Where possible, Cardsphere and Cardsphere administrators will use the following guidelines to resolve disputes:

  1. No show. Any disputes where one of the users does not respond to inquiries regarding the dispute in a reasonable time are ruled against the non-responsive user.
  2. Not received. Any disputes that involve lost Items or Items that have not been shipped are ruled in favor of the Receiver as Full Refund, unless it has been established that the Receiver has violated their obligations.
  3. Not as described. Any disputes that involve Items that are not as described are ruled in favor of the Receiver. Receivers may choose to return such items or adjust pricing to the appropriate amount for the condition received, and a Split ruling may be issued.

Cardsphere reserves the right to issue dispute rulings at the discretion of Cardsphere administrators.

Referral Program

When you refer new users to sign up for a Cardsphere account, you may earn up to one Reward for each user referred. These terms and conditions govern your eligibility for and participation in the Referral Program ( the Program), as operated by the Company.

The Participants referred to below are you (the Qualified User), and the person you've referred (the Referred User).

Referrals take place when a Qualified User provides their unique referral link as provided by the System to a Referred User.

A Qualified User must meet all of the following conditions:

  • Be legally allowed to render such referrals in their ruling jurisdiction.
  • Not be engaged in any activity attempting to subvert the function and spirit of these terms for personal gain or otherwise.
  • Must not engage in mass solicitation of referrals via any medium which requires targeted delivery. For example this means it's acceptable to post your referral link on social media, but you may not send mass messages which may by any person be considered spam.
  • Must not obfuscate the purpose of the link when making it public.

A Referred User must meet all of the following conditions:

  • Not be engaged in any activity attempting to subvert the function and spirit of these terms for personal gain or otherwise.

The Reward consists of thirty (30) days of Cardsphere membership as described herein.

The Reward is awarded as soon as the Referred User completes a trade as either Sender or Receiver with a user other than the Qualified User who provided the referral link. If membership is already active, additional time will be appended to the current subscription renewal date.

The Reward has no value explicit or implied and cannot be transferred, exchanged or refunded.

Reporting Card Issues

Users of the Service are provided with a feature to report current or expected price changes on cards. When enough users have reported such an issue in a 24 hour period, new trades are suspended. Trading resumes when an administrator chooses, or when the amount of reporting users drops below the threshold required in a 24 hour period to suspend trading.

Use of this feature is appropriate only when:

  • A "banned and restricted" announcement involving the card has been made.
  • A reprint has been announced.
  • For either the above, or any other reason, a significant spike or drop in the card value has happened or is about to happen.

Reporting an issue on a card is not appropriate when the Cardsphere index price does not exactly match the price on an external source, but no rapid or significant price change has occurred or is expected to occur.
